No Attorney–Client or Attorney–Attorney Privilege Until Engagement Is Confirmed

Information, documents, or messages (including texts, emails, and form submissions) that you transmit to Edelstein Law, LLP before we have (1) a signed referral or co-counsel agreement or (2) a signed attorney–client engagement letter are not privileged or confidential. Privilege attaches only after:

  1. Attorney-to-Attorney Engagement

    We and the referring lawyer have executed a written referral or co-counsel agreement, establishing a professional relationship between counsel; or

  2. Attorney-Client Engagement

    We and the prospective client have executed an engagement letter, thereby creating an attorney–client relationship.

Once either of those written agreements is in place, all subsequent communications and materials exchanged will be protected by the attorney-client privilege, the attorney-work-product doctrine, and any applicable common-interest or joint-defense privileges to the fullest extent of the law.
