Acceptance of These Terms
By accessing or using any website, application, or online service (collectively, the “Site”) operated by Edelstein Law (“we,” “our,” or “the Firm”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, please refrain from using the Site.
II. No Attorney-Client Relationship
Your use of the Site, including any contact through email, forms, or other means, does not create an attorney-client relationship with Edelstein Law. Such a relationship is formed only upon the execution of a written engagement agreement signed by the Firm and you.
III. No Legal Advice
Content on the Site is provided for general informational purposes only and should not be construed as legal advice. You should not act—or refrain from acting—on the basis of any information found here without seeking professional counsel in your jurisdiction.
IV. Permitted & Prohibited Uses
You may use the Site solely for lawful purposes and in accordance with these Terms. You agree not to:
transmit malware, harmful code, or unsolicited advertising;
engage in data mining, scraping, or other automated data-collection;
impersonate any person or entity or misrepresent your affiliation with Edelstein Law;
use the Site in any manner that could damage, disable, overburden, or impair our servers.
V. Intellectual-Property Rights
All text, graphics, logos, and other content on the Site are the property of Edelstein Law or its licensors and are protected under U.S. and foreign intellectual-property laws. You may download or print materials for personal, non-commercial use only, provided that you keep intact all proprietary notices.
VI. User-Submitted Content
If you submit or upload any content (“User Content”), you grant Edelstein Law a non-exclusive, royalty-free, worldwide license to use, reproduce, and display such content for Site operation. You represent that you own or have the rights to any User Content you submit and that it does not violate any third-party rights.
VII. Privacy
Our separate Privacy Policy explains how we collect, use, and protect personal information. By using the Site, you consent to our data practices described therein.
VIII. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or secure.
IX. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, EDELSTEIN LAW, ITS PARTNERS, ASSOCIATES, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. DIRECT DAMAGES, IF ANY, SHALL BE LIMITED TO FIFTY U.S. DOLLARS (US $50).
X. Indemnification
You agree to defend, indemnify, and hold harmless Edelstein Law and its affiliates from and against any claims, liabilities, damages, judgments, costs, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your use of the Site.
XI. Modifications to the Terms
We may revise these Terms at any time. All changes are effective immediately when posted and apply to all subsequent use of the Site. Your continued use after changes are posted constitutes acceptance.
XII. Governing Law & Jurisdiction
These Terms are governed by the laws of the Commonwealth of Pennsylvania without regard to conflict-of-law principles. Any legal action arising out of these Terms or the Site shall be brought exclusively in the state or federal courts located in Philadelphia, Pennsylvania, and you consent to personal jurisdiction therein.
XIII. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
XIV. Entire Agreement
These Terms and our Privacy Policy constitute the sole and entire agreement between you and Edelstein Law regarding the Site and supersede all prior understandings.
