How long do you have to file a claim after a car accident in Philadelphia?

The quick answer is two years; however, nothing in the injury-accident world is simple or easy (which is why we need professionals).

According to Pennsylvania law, a person has up to 2 years to file a claim--depending on if it's a civil or government entity. This means that, if you get into an accident with another civilian, you technically have up to two years to file a claim (not that you should wait that long). On the other hand; if you unfortunately, you get into an accident with a government entity, you should file a claim within six months.

Accidents are traumatic; oftentimes the details slip away over time and become less clear. At the moment, we don’t realize what we need to know or document. Essential details literally slip through the cracks. Professionals help you sift through the events to document important details to help with your case.

Collect Detailed Information Regarding the Accident

Even if you feel the accident was mild, it’s always important to collect as much information as possible at the time of the accident. Oftentimes, accident injuries do not show up until after the fact. If you are injured; always collect medical and billing information related to any injury accident.

At the bare minimum always collect the following:

  • Name and contact info of the person involved

  • Exchange insurance information

  • Exchange driver license and license plate information

  • Document the type of vehicle and the location of the accident

  • Write down as much of the accident as you can remember

Another key point to try and remember is, Pennsylvania has a no fault injury law. This means that no matter who is at fault, if you are injured, your insurance will cover any related medical bills.

Why Consult an Accident Attorney?

Accidents are very stressful and the average person doesn’t have time to research laws, communicate with insurance companies, get rental vehicles or file for compensation. While you are recovering, let a professional handle the tedious but pivotal details.

Consulting with a Philadelphia car accident lawyer is always a good idea. They can assist you with every step of the process and since they are professionals, they”ll often consider things you don’t. They can help you collect evidence, retain privacy and help you negotiate compensation. Injury accidents are complicated and that’s why it’s important to hire a professional to manage all the important details.
