Pennsylvania Institutional Sexual Assault Statute

Under the legal state statute, the crime of institutional sexual assault is defined as sexual misconduct between two people that have a specific relationship. Typically, one is in a position of power or authority over the other. For example, a teacher having sexual contact or intercourse with a student. The age of the victim doesn’t matter in the state of Pennsylvania, meaning that even if you are 18 years-old or older you are still a victim.

Institutes include:

·  Religious organizations

·  Nursing homes and similar care facilities

·  Medical facilities such as hospitals

·  Department of Corrections such as jail

·  Schools

The penalties are severe for institutional sexual assault in Pennsylvania. Victims need to know they can do something about it and that the perpetrator will have to face consequences. Those convicted can face up to seven years in prison and up to a $15,000 fine. In addition, the crime will remain on their permanent record and they will need to register as a sexual offender.

Common Institutional Sexual Assault Examples

Unfortunately, many organizations prey on victims. To pursue justice and to prevent this from happening again, it’s important for victims to come forward and hold those accountable. 

Schools

Often times, schools will deny or ignore any signs of sexual assault and when allegations do arise, they usually don’t respond effectively. This is because they are concerned about its public perception.  

When a student is sexually assaulted by a teacher or any employee of the school, it is important for victims to speak up to put a stop to this behavior in the organization.

Hospitals

Patients should fully understand the exams and treatments they receive to avoid any confusion. If for any reason you do feel uncomfortable, always speak up. Common signs of sexual misconduct between a doctor, or another employee of the hospital, and the patient include declining to have more people in the room during an exam, not wearing gloves during an exam, or examining private areas of the patient that have nothing to do with the visit.

Nursing Homes

Patients at nursing homes are more vulnerable due to their declining health, making these establishments a commonplace for institutional sexual assault.

Sexual assaults in nursing homes usually go unreported since victims can’t document the incident or have a hard time discussing the details. Signs to look for include bruises, acting fearful, or abnormal behaviors.

 If you have a loved one in a nursing home, make the habit to visit often and be open to talking to them about their feelings. 

Religious Organizations

Sexual assault within a religious organization has been a long-standing problem and is often covered up. Institutional sexual assault can happen at churches, religious schools, and on missions. Younger members of these institutions are usually the victims, but anyone attending these religious organizations can be preyed upon.
